Article 1. Subject
These general terms and conditions of sale apply to all sales made by the RKB Group via the www.bestseller-iptv.com website. The acquisition of a product through this site implies the buyer’s unreserved acceptance of these terms and conditions of sale, which the buyer acknowledges having read prior to ordering. Prior to any transaction, the buyer declares on the one hand that the purchase of products on the www.bestseller-iptv.com website is not directly related to his/her professional activity and is limited to strictly personal use, and on the other hand that he/she has full legal capacity, enabling him/her to commit to the present terms and conditions of sale. The RKB Group reserves the right to modify these terms and conditions at any time, in order to comply with new regulations or to improve the use of its website. Consequently, the applicable conditions will be those in force at the date of the buyer’s order.
Article 2. Products
The products offered are those shown on the RKB Group website www.bestseller-iptv.com, while stocks last. The RKB Group reserves the right to change the product range at any time. Photos are for illustrative purposes only. Article 3. Prices
The prices shown on the product sheets of the internet catalog are in Euros (€), inclusive of all taxes (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. The RKB Group reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order and the place of delivery. Delivery is free for all orders (shipping not included).
Article 4. Orders and payment terms
Before placing an order, the purchaser must create an account on the www.bestseller-iptv.com website. The account creation section is accessible directly from the side menu bar. Each time the purchaser visits the site, he/she must identify him/herself using this information if he/she wishes to order or consult his/her account (order status, profile, etc.). The RKB Group offers the buyer the option of ordering and paying for its products in several stages, with 2 payment options to choose from:
Payment by bank transfer: the buyer selects the products he/she wishes to order in the “basket”, modifies them if necessary (quantities, references, etc.), checks the address or enters a new one. The buyer then selects the payment method of their choice: “Payment by bank transfer”. In the final step, the buyer checks all the information, acknowledges and accepts the present terms and conditions of sale by ticking the appropriate box, and then clicks on the “Confirm my order” button to confirm the order. This last click constitutes the final conclusion of the contract. As soon as the order has been validated, the buyer receives an order form confirming that the order has been registered. In order to finalize payment and process the order, the purchaser must contact his/her bank to transfer the amount of the order to the RKB Group bank account, whose details have been communicated to the purchaser. Upon receipt of the transfer, the order will be processed and the buyer will be informed by e-mail. The RKB Group will ship the products at the earliest 2 hours after receipt of the transfer corresponding to the order, subject to provisions.
Secure payment by Paypal or credit card: the buyer selects the products he or she wishes to order in the “shopping basket”, modifies them if necessary (quantities, references, etc.), verifies the address or enters a new one. The buyer then selects the payment method of their choice: “Payment by Paypal”. The next step is to check all the information, read and accept the present terms and conditions of sale by ticking the appropriate box, and then confirm the order by clicking on the “Confirm my order” button. Finally, the buyer is redirected to the PAYPAL secure interface, where he/she can enter his/her Paypal account details or personal credit card details. If the payment is accepted, the order is registered and the contract definitively formed. Payment by Paypal account or credit card is irrevocable.In the event of fraudulent use of the card, the purchaser may demand cancellation of the card payment, in which case the sums paid will be credited back or refunded. The cardholder is not liable if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that may have been incurred, the cardholder must contest the debit in writing to his or her bank within 70 days of the transaction, or 120 days if provided for in the contract with the bank. The amounts debited will be reimbursed by the bank within one month of receipt of the cardholder’s written objection. The cardholder will not be charged for the return of the sums.
Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof, and waiver of the right to invoke one’s own terms and conditions of purchase. All data supplied and the recorded confirmation shall constitute proof of the transaction. If the purchaser has an e-mail address and has entered it on the order form, RKB Group will send confirmation of the order by e-mail. Article 5. Withdrawal
In accordance with article L221-18 of the French Consumer Code, the purchaser has a period of fourteen working days from the date of delivery of his order to exercise his right of retraction. They have a period of fourteen days following communication of their decision to retract in accordance with article L. 221-21 to return the product to the seller for exchange or reimbursement without penalty, with the exception of return costs (see the model retraction form below).
Article 6. Delivery
Deliveries are made by e-mail or SMS.
Article 7. Warranty
All products supplied by RKB Group are covered by the legal warranty provided by articles 1641 et seq. of the French Civil Code.
The terms and conditions for exercising the legal warranty of conformity are set out in articles L.217-4 to L.217-13 of the French Consumer Code.
According to article L.217-4, the seller delivers goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation, when the latter is his responsibility under the contract or was carried out under his responsibility.
According to article L.217-5: Goods conform to the contract :
1° If it is functional for the use usually expected of similar goods and, where applicable :
– if it corresponds to the description given by the seller and possesses the qualities that the seller presented to the buyer in the form of a sample or model ;
– if it has the qualities that a buyer may legitimately expect, having regard to public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the seller’s attention and accepted by the latter.
In the event of non-conformity of a product sold, it may be returned to the RKB Group, which will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by e-mail to www.bestseller-iptv.com within thirty days of delivery.
Article 8. Liability
The RKB Group, in the distance selling process, is only bound by an obligation of means. It cannot be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems.
Article 9. Intellectual property rights
All elements of the www.bestseller-iptv.com site are and remain the exclusive intellectual property of KB Group. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text.
Article 10. Personal data
The company RKB Group undertakes to preserve the confidentiality of information provided by the purchaser, which he may be required to transmit for the use of certain services. All information concerning the purchaser is subject to the provisions of law no. 78-17 of January 6, 1978. As such, Internet users have the right to access, modify and delete information concerning them. They may request this at any time by e-mail to the following address: www.bestseller-iptv.com.
Article 11. Settlement of disputes – Mediation
The present conditions of distance selling are governed by French law.
In accordance with article R631-3 of the French Consumer Code, for any dispute or litigation, the consumer may refer the matter either to one of the courts having territorial jurisdiction under the French Code of Civil Procedure, or to the court of the place where the consumer resided at the time of the conclusion of the contract or the occurrence of the harmful event.
The customer is informed of the possibility of resorting, in the event of dispute, to a conventional mediation procedure or any other alternative dispute resolution method.
